Marketing Rules for "e8-2C" ONE HOME Package by China Telecom Shanghai

 

1.    Name: "e8-2C" ONE HOME Package

 

2.    Marketing Period: September 13, 2007 – December 31, 2007

 

3.    Target Subscribers: The package is meant for those residential subscribers in Shanghai, with subscription to both fixed-line telephone (already installed or to be installed, ISDN and prepaid telephone excluded) and flat-rate 4M ADSL (already installed or to be installed) by China Telecom Shanghai

 

4.    Product Mix: Fixed-line telephone, ADSL, IPTV, WLAN, value-added services based on fixed-line telephone and broadband, home monitoring, video phone and fixed-line phone payment by China Telecom Shanghai

 

5.    Scheme

 

A.    Basic Package

Name: e8-2C

Monthly Usage Fee: 298 yuan

ONE HOME Communication      

High-speed broadband: 4M ADSL (flat rate)

Wireless Internet access at public areas, 400 minutes/month      

Telephone: 600 minutes (local and domestic toll)

Caller ID, color ring tones for fixed-line telephone, color ring tone box

ChinaVnet Entertainment: free access to an ocean of audiovisual programs

ONE HOME Information

ONE HOME Assistant: family meeting, information services for everyday life, information on travel, stocks, etc.

Optional Packages

□        Home Monitoring      

50 yuan/month/channel

Subscribers should purchase the device. Other charges are in accordance with the standard tariffs of MEGA EYES (Home Edition). This is currently only open to subscribers in Pudong and West District.

□        Video Phone    

30 yuan/month/line

Subscribers should purchase the device. The usage fee is charged according to the standard tariffs for New Vision.

□        Fixed-line Phone Payment 

4 yuan/month/line

Subscribers should purchase the device. The usage fee is charged according to the standard tariffs for ordinary fixed-line telephone. This is currently only open to subscribers in Pudong and West District.

□        Friends & Family Toll Calls      

Five toll numbers (fixed-line telephone, mobile phone or PHS) to be called domestically or internationally can be set at the fixed-line telephone bundled with the basic package, as the Friends & Family Numbers to which calls made by the above-mentioned fixed-line telephone are charged as Friends & Family Toll Calls (free new account and number change during the period when the rules are valid).

 

B. Notes:

 

a.     The basic package comes with only one fixed-line telephone, one ADSL line and one line of IPTV over broadband. ADSL（or FTTB+LAN）and IPTV over broadband are to be billed together with fixed-line telephone on the same account.

 

b.    Monthly usage fee means the monthly charge a subscriber pays for the usage of the chosen package. During the period when the rules are valid, if the actual monthly communication time with the fixed-line telephone (local plus domestic toll) in the basic package is no longer than 600 minutes, the subscriber is charged in accordance with the rate of the chosen package. If the actual monthly communication time is longer than 600 minutes, in addition to the monthly usage fee, the subscriber should also pay the extra according to the following rates: 0.15 yuan/minute for both local calls (within the service area or between the service areas) and domestic toll calls. The charge of local calls does not cover the charge for dial-up Internet connection.

 

c.    The monthly rents for the fixed-line telephone, broadband and IPTV are already included in the monthly usage fee of the basic package.

 

d.    The package subscriber with newly installed broadband is charged at a preferential price of 160 yuan/line (previously 310 yuan/line) for the one-time installation and testing.

 

e.     The package subscriber is eligible for free use of one home gateway device, and free installation, testing and maintenance by China Telecom Shanghai. The device should return to China Telecom Shanghai, if the subscriber does not renew the subscription after the period when the rules are valid.

 

f.     The IPTV in the package is a one-for-all IPTV package, delivered over broadband (delivery scheme B). The charge for the IPTV contents and applications, except those additionally specified, are covered in the package. Optional contents and applications that are not included in the package are charged in accordance with the usage. Due to the IPTV over broadband (4M), the Internet connection will be degraded to 2M, while IPTV and Internet surfing are in the process simultaneously.

 

g.    The subscribers with newly installed IPTV are eligible for free one-time installation and testing (previously 310 yuan/line) and free use of the set-top box (STB).

 

h.    The color ring application in the basic package does not cover the customized ring tones charged additionally.

 

i.     The package subscribers are eligible for free use of wireless Internet access at public areas (up to 400 minutes only in the month). The extra is charged at the rate of 0.06 yuan/minute. To get the wireless Internet access at public areas, the subscriber must use the user name registered during the preference period for authentication. The benefit is not for the Wireless Internet access with other user names.

 

j.     The connection for fixed-line phone payment is charged at the rate specified for the package, i.e. 0.15 yuan/minute. The subscriber applying for the fixed-line phone payment by October 31, 2007, is charged 200 yuan (previously 680 yuan) for one terminal. The optional package goes into effect the next month.

 

k.    The subscriber that applies for home monitoring is eligible for free one-time installation and testing (previously 110 yuan/line for each time). Other charges are in accordance with the standard tariffs of MEGA EYES (Home Edition). The optional package goes into effect the next month.

 

l.     The subscribers applying for Friends & Family Toll Calls enjoy free new account (previously 2 yuan/line for each time) and number change (previously 2 yuan/number for each time) during the period when the rules are valid. The application goes into effect in 48 hours, while the number change will take place on the first day of the next month.

 

m.   The more optional packages you choose, the bigger discount of the monthly usage fees you get: 10% off for two items, 20% off for three items and 30% off for four or more items.

 

n.    Apart from the package preference specified, other charges of the fixed-line telephone, broadband and IPTV in the package are in accordance with the standard tariffs currently in effect.

 

6.    Special Attention

 

A. The rules are valid for two years, starting from the first day of the next month, after the basic package is ordered and all the services offered. If the subscriber does not apply for the renewal prior to the expiry of the rules, the preference period of the package (including the optional packages) will be terminated as the period when the rules are valid ends.

After the period when the rules are valid ends, subscribers can apply for the service cancellation. If a subscriber does not apply for the service cancellation (including that for the optional packages), but continues the use of fixed-line telephone, broadband, IPTV and other related services by China Telecom Shanghai, the charges are in accordance with the corresponding tariffs currently in effect. Subscribers can also apply for other marketing schemes by China Telecom Shanghai.

 

B. In the period between the date when application is handled and the date when the package contract is in effect, the monthly rents and usage fees for the fixed-line telephone, broadband and IPTV in the basic package are in accordance with the standard tariffs for the specific products (calculated on a per diem basis).

 

C. In the period between the date when application is handled and the date when the optional packages are in effect, the monthly rents and usage fees for the related products in the optional packages are in accordance with the standard tariffs for the specific products (calculated on a per diem basis).

 

D. The package subscribers are customers of the ONE HOME brand by China Telecom. However, the subscribers should go to the business outlets of China Telecom Shanghai and apply for the Integrated Telecom Cards. Only after that, can the subscribers earn their points and enjoy services of higher standard. See the details in Rules for ONE HOME Points.

 

E. Warranty is granted for the devices used free of charge. The related manufacturers will be responsible for the after-sale services, with three guarantees of repair, replacement and return, as regulated by the state.

 

F. 4M ADSL means that on the ideal networking conditions, the downlink rate of Internet connection will be up to 4096 kbps.

 

G. This scheme is not for those subscribers who have already been with other marketing schemes for fixed-line telephone, broadband, IPTV, toll calls, and etc. by China Telecom Shanghai.

 

H. The subscribers with default are not eligible for the marketing scheme, until the default is cleared. 

 

I、During the period when the rules are valid, subscriber should properly use the devices like home gateway freely provided by China Telecom Shanghai. Subscribers should be liable for the damages caused by their improper use, at their expense for repair or replacement.

 

J. During the period when the rules are valid, without the consent of China Telecom Shanghai, subscribers are not supposed to lend, rent out, sell or present the devices like home gateway, freely provided by China Telecom Shanghai, to others or use them for services by other operators. Once identified, China Telecom Shanghai reserves the right to terminate the service.

 

K. During the period when the rules are valid, those package subscriber that change the account, terminate the service but keep the number or cancel the service for the fixed-line telephone, broadband or IPTV in the basic package would be considered as the subscribers who give up the scheme, and lose the benefits for the chosen optional packages.

 

L. During the period when the rules are valid, if the services of fixed-line telephone, broadband and IPTV in the package are fully or partially suspended due to subscribers’ liability like default, China Telecom Shanghai will go on with the monthly accounting and demand the monthly usage fees for the chosen package, even in the suspension period. If the suspension reaches 60 days, and the subscriber remains with the reasons (such as default) that lead to the suspension, China Telecom Shanghai reserves the right to terminate the services.

 

M. During the period when the rules are valid, if the contract is terminated ahead of time due to the subscribers’ liability, the subscribers should clear the account and pay the difference between the discount rates for the basic package and optional packages and the standard rates (including one-time charges and usage fees). The subscriber should keep the devices freely provided intact and return them to China Telecom Shanghai, or pay for the devices at a full price (800 yuan for a set-top box and 400 yuan for a home gateway).

 

N. The subscriber who selects the fixed-line phone payment and gets the free use of terminals should pay 480 yuan for the difference caused by the discount, if the contract is terminated within the period of once year, since the date when application is handled.

 

O. The rules are supplement to Service Agreement for Services by China Telecom Shanghai, Service Agreement for Broadband Access Services by China Telecom Shanghai, Service Agreement for PHS Services by China Telecom Shanghai, and Service Agreement for IPTV Services by China Telecom Shanghai. In the event that any of the terms, conditions, and notices contained herein conflict with the terms and guidelines contained within the above-mentioned agreements, then the terms specified in the rules shall control.

7.    During the period when the rules are valid, China Telecom Shanghai will provide the services in accordance with the laws and regulations like Telecommunication Regulation of the People’s Republic of China. China Telecom Shanghai will be liable for any violation.

Appendix A Charges for MEGA EYES (Home Edition)

Appendix B New Vision Tariffs

 

Point-to-point video communication (video phone) that bypasses the video communication platform 

Local: 0.5 yuan/minute

Domestic toll: 1 yuan/minute

Video communication number calls fixed-life telephone

Local: 0.20 yuan for the first three minutes, and then 0.10 yuan/minute

Domestic toll: the same to the rates for IP telephony by China Telecom Shanghai

 

Appendix C Tariffs for Friends & Family Toll Calls

 

1. New account: 2 yuan/line (each time)

2. Number change: 2 yuan (each time)

3. Usage:

（1）Domestic toll: 0.15 yuan/minute:

（2）Hong Kong, USA, Canada and Singapore: 0.40 yuan/minute;

（3）Macao and Taiwan: 0.60 yuan/minute:

（4）UK, France, Italy, Germany, Korea (Rep.), Japan, Australia, New Zealand, Malaysia, Indonesia, the Philippines and Thailand: 1.00 yuan/minute.

Note: While USA (including Alaska and Hawaii) and Canada are mentioned in the tariffs, other countries or regions with the area code of "1" are excluded
